By downloading, accessing, or using uNepal (the “App”) you agree to these Terms and to our Privacy Policy and Community Guidelines (together, the “Policies”). If you do not agree, please do not use the App.
1) Who may use uNepal
- Minimum age: You must be 13+. If you’re 13–17, you confirm you have parental/guardian consent.
- One person—one account: Don’t create multiple accounts to evade limits, bans, or posting rules.
- Where we focus: We design for Nepalis in Australia—but anyone may use the App if they follow these Terms.
2) Your account & security
- Accuracy: Provide true, current details (name, email/phone) and keep them updated.
- Keep it safe: You’re responsible for your login and device. Tell us promptly about unauthorised access.
- Verification: We may ask for ID or proof (e.g., business licence, right-to-let) to keep the platform safe.
- Compatibility: You need a compatible device/OS and data plan. Network/app store fees are yours.
3) What uNepal is (and isn’t)
- Platform only: We provide community spaces and listings. We do not broker, insure, guarantee, pay for, or become a party to any user-to-user transaction (rentals, jobs, services, buy/sell). You must verify people, listings and legal compliance yourself.
- No custody of funds: Dhukuti, SplitBill and Gatherings are organisational tools. uNepal does not hold, transfer or settle money, and is not a bank, remittance, or financial advice service.
- Information only: Content in the App is general information—not legal, financial, tenancy, employment or migration advice.
- Third-party media/links: Radio streams and external links are third-party. Availability can change.
4) Your content & permissions
- You own it: You retain rights in content you post (“User Content”).
- Licence to us (service operation): You grant uNepal a worldwide, royalty-free, transferable, sublicensable licence to host, store, reproduce, adapt, publish, display and distribute your User Content to operate, protect, promote and improve the App, including in aggregated/anonymised analytics and safety systems.
- Your promises: Content must be lawful, accurate, and not infringe IP, privacy or publicity rights; you have consent for people shown.
- Retention & backup: You are responsible for backups. We may remove/retain content per law and our Policies (e.g., after reports/appeals or legal holds).
5) Acceptable use (what’s not allowed)
You agree not to post, list, message or otherwise engage in:
- Illegal, harmful or deceptive conduct: fraud, scams, impersonation, doxxing, harassment, threats, sexualisation of minors, or instructions to commit crimes.
- Hate/discrimination: content that promotes hatred or discrimination against protected attributes (see national and state anti-discrimination laws).
- Spam & manipulation: bots/scraping without consent, mass unsolicited messages, fake reviews/ratings.
- IP abuses & unsafe goods: counterfeit items, unauthorised IP use, or regulated/prohibited items (weapons, illicit drugs, etc.).
- Security interference: bypassing access controls, probing, scraping sensitive data, reverse-engineering beyond what law allows.
- Non-compliant jobs/rentals: job ads below minimum legal pay or otherwise unlawful; rental ads that breach state/territory requirements (e.g., misrepresentations, banned rent-bidding, discriminatory terms).
Details live in the Community Guidelines—breaches may lead to removal, limits, or account closure.
6) Listings: Rentals, Jobs, Services, Marketplace
- Accuracy & disclosures: Listings must be truthful, current, include required disclosures (e.g., fixed rent where required), and comply with relevant laws.
- Jobs compliance: Don’t advertise pay below minimum entitlements; include required pay info where applicable.
- Proof & checks: We may request documents (e.g., ownership/right-to-let, licences). Listings failing checks can be removed.
- No guarantees: We don’t verify each listing or guarantee outcomes (tenancy secured, job obtained, service quality).
- Reviews/ratings: Must be honest and based on genuine experiences; we may moderate for conflicts/fraud.
7) Banners, notifications & messaging
- Service messages: You’ll receive service/transactional notices (e.g., policy updates, safety).
- Marketing: Where required, we obtain consent and include easy opt-out for commercial electronic messages under the Spam Act 2003.
- Saved alerts: You control saved searches/alerts in settings.
- Security note: Messaging/communications in the App may not be end-to-end encrypted.
8) Privacy & data
- Privacy Policy: Our Privacy Policy explains what we collect and why, security measures, and your choices under the Privacy Act 1988 and Australian Privacy Principles (APPs).
- Data breaches: We follow the Notifiable Data Breaches (NDB) scheme where it applies, including assessing suspected breaches and notifying affected individuals and the OAIC for eligible breaches.
- Electronic consent: You consent to electronic communications consistent with the Electronic Transactions Act 1999.
9) Intellectual property
- Our IP: The App, UI, software, design, logos and trademarks (including uNepal) belong to us or our licensors.
- Your licence to use the App: We grant you a personal, revocable, non-transferable licence to use the App on your device.
- Feedback: Ideas/suggestions may be used without obligation or compensation.
10) Third-party services & stores
The App uses third-party services (e.g., hosting, analytics, messaging, radio streams, and—if introduced—payments). Their terms apply. You also agree to the Apple App Store and Google Play terms. Apple/Google are not parties to your agreement with uNepal.
11) Future paid features
- Today: the App is free.
- Future: we may offer paid placements (e.g., Featured listings/banners), subscriptions or other paid features with clear pricing and supplemental terms. uNepal will not hold or transmit user funds unless expressly stated in future product terms.
12) Safety, reporting & takedowns
- Moderation: We may review, demote, restrict or remove content/accounts that may cause harm or breach these Terms/Policies.
- Report tools: Use in-app reporting for scams, harassment, illegal or restricted content. We follow applicable Online Safety Act 2021 processes and regulator guidance for illegal/restricted content.
- Lawful requests: We may act on lawful notices and cooperate with regulators/law enforcement as required.
13) Australian Consumer Law, warranties & disclaimers
- Your mandatory rights: Nothing in these Terms excludes your non-excludable rights under the Australian Consumer Law (ACL).
- Service basis: Except for non-excludable guarantees, the App is provided “as is” and “as available”. We don’t guarantee uninterrupted or error-free operation, or the accuracy/availability of User Content or third-party services.
- Your responsibility: You are responsible for decisions and transactions with others.
14) Liability cap
To the maximum extent permitted by law: (a) we will not be liable for indirect, incidental, special or consequential loss, or loss of profits, data or goodwill; and (b) if liability cannot be excluded, our aggregate liability is capped at AUD $100 or the amount you paid to us in the 12 months before the claim—whichever is greater. This cap doesn’t limit liability that cannot be limited under the ACL.
15) Indemnity
You indemnify uNepal (and our officers, employees, agents) against losses, claims and costs arising from: (a) your use of the App, (b) your User Content, (c) your breach of these Terms or law, or (d) your transactions with others.
16) Suspension & termination
We may suspend or terminate access where we reasonably believe there’s a breach, risk to users/us/third parties, or to comply with law. You may close your account in settings or by emailing us. Clauses that reasonably should survive termination do survive.
17) Changes to these Terms
We may update these Terms. For material changes, we’ll give reasonable notice (e.g., in-app or email). Continuing to use the App after the effective date means you accept the changes.
18) Disputes & governing law
- Talk to us first: Email hello@unepal.com within 30 days of an issue; we’ll try to resolve it quickly.
- Mediation (optional): If unresolved, either party may propose mediation in Canberra, ACT.
- Courts: These Terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia. ACT courts have non-exclusive jurisdiction.
19) General
- Severability: If a clause is invalid, the rest remains effective; modify the clause to the minimum needed to reflect intent.
- Assignment: You can’t assign your rights without consent. We may assign to an affiliate or successor with notice.
- No waiver: A failure to enforce isn’t a waiver.
- Language: English prevails.
